Web3 Trading Terms & Conditions

Welcome to Token.com's Web3 Trading. This environment enables registered Token.com users to connect their self-custodial wallets, interact with decentralised exchanges (DEXes), and engage with community-generated content. Please read these terms of service carefully as they govern your use of our services.

1. Agreement to Terms

By accessing or using our Web3 Trading, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services.

2. Definitions

  • "User Content": Files, data, and information submitted or stored by you through the services.

  • "Services": The Web3 environment and related services provided by Token.com.

  • "Crypto-asset": digital assets supported by the Web3 environment.

  • "Personal Data": Any information relating to an identified or identifiable natural person.

3. Eligibility

To use our services, you must:

  • Be a registered Token.com user.

  • Be at least 18 years old and legally competent to enter into these Terms.

  • Not be a resident of a sanctioned jurisdiction or territory or / and subject to international sanctions 

  • Comply with all applicable laws and regulations.

4. Wallet Services

  • Self-Custody: You control and are solely responsible for your wallet, including the connection credentials. Token.com does not have access to your wallet or its contents.

  • Wallet Connection: Connect your self-custodial wallet to access decentralised exchanges and manage transactions.

  • Access to DEXes: Connect your self-custodial wallet to access decentralised exchanges and manage transactions.

  • Community Interaction: Share, publish, and engage with community-generated content within the app.

Use of DApps and DEXes

If you access or use decentralised applications (DApps) or decentralised exchanges (DEX), including any DApp functionality embedded within the Services such as the Trade/Swap function, you acknowledge and agree that:

  • Third-Party Responsibility: Token.com is not responsible for your access or use of DApps or DEX and shall have no liability whatsoever in connection with your use of these services, including any disputes over transactions.

  • Transaction Limits: The limits on amounts that you may exchange via DEX per day are subject to the requirements of third-party developed Smart Contracts.

  • Irrevocability of Transactions: Blockchain operations are irrevocable. You are solely responsible for the consequences of any issues associated with such transactions, including but not limited to transfers to incorrect addresses or problems with the node servers you select.

  • Fees and Costs: When using DApps or DEX, third-party developed Smart Contracts may charge handling fees and/or service fees. Any information displayed by Token.com related to such fees is for reference only. Token.com does not guarantee the accuracy, applicability, reliability, integrity, or appropriateness of this information and is not liable for any loss or damage resulting from your use of these contents.

5. Supported Digital Assets

The Web3 Trading supports various digital assets. Supported assets may change at any time without notice. You are responsible for ensuring your assets are supported.

6. Security and Confidentiality

You are responsible for the confidentiality and security of your wallet connection credentials. Token.com is not liable for any loss or unauthorised access due to your failure to secure these.

7. Use of Services

When using our services, you agree not to:

  • Engage in illegal activities.

  • Use automated means to access the services.

  • Interfere with the functioning of the services.

  • Share your wallet connection credentials with anyone.

8. Third-Party Services

When using our Services, you may interact with third-party services. Token.com does not control or endorse these third-party services and is not liable for any content or services they provide. You are solely responsible for any fees associated with these third-party services, such as gas fees. If there is a conflict between these Terms and any third-party terms, these Terms will prevail. You are responsible for any actions taken by third parties with access to your wallet through our Services.

9. Transaction Fees

Transaction fees (e.g., gas fees) are associated with blockchain transactions. You must ensure you have sufficient funds to cover these fees. Token.com is not responsible for transaction failures due to insufficient funds.

10. Taxes

You are solely responsible for determining what taxes apply to your use of the Services and for reporting and remitting the correct taxes to the appropriate tax authorities. Token.com has no responsibility or liability for determining or collecting taxes.

11. Limitation of Liability

Token.com is not liable for indirect, incidental, or consequential damages arising from your use of the services. Our liability is limited to the extent permitted by law.

12. Dispute Resolution

Disputes will be resolved through binding arbitration in [Location]. Both parties waive the right to a jury trial or class action.

13. Termination

We may suspend or terminate your access to the services at any time. Upon termination, your access to digital assets will depend on your possession of the necessary wallet credentials.

These Terms are governed by the laws of the British Virgin Islands. Any disputes arising from these Terms or your use of the Services will be subject to the exclusive jurisdiction of the courts of the British Virgin Islands.

  • Force Majeure: We are not liable for any delays or failures in performance due to events beyond our reasonable control.
